This Acceptable Use Policy describes obligations of users of the ONEEIGHTY NETWORKS Internet Access services (the "Services"). The use of the Services is also governed by a separate services agreement between ONEEIGHTY NETWORKS and each user.

 

Prohibited or Unlawful Use of the Services
 
Use of the Services for any purpose that is unlawful or in any manner which could damage, disable, overburden, or impair the Services or interfere with any other Party's use and enjoyment of the Services is prohibited. Users may not use the Services to commit, aid or abet any violation of copyright or intellectual property law.

 
Security Issues
 
Users may not: (i) attempt to use or gain unauthorized access to data, accounts, hosts, systems or networks of ONEEIGHTY NETWORKS or any other party, including any attempt to probe, scan or test the vulnerability of a system or network of ONEEIGHTY NETWORKS or any other party, or any attempt to breach the security or authentication measures of ONEEIGHTY NETWORKS or any other party; (ii) interfere with service to any user, host or network including, without limitation, mailbombing, flooding, and attempting to deliberately overload a system; or (iii) forge any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

 
E-Mail and Usenet News
 
Users may not use the Services to: (i) publish or send duplicative, unsolicited e-mail messages (commercial or otherwise), or to collect the responses from unsolicited e-mail; (ii) publish, send, or deliver any private e-mail message to any third parties, by any means, without the express prior consent of the author of the content of such e-mail message; (iii) post advertisements or messages that violate the charter of any newsgroup or mailing list, which determination you agree shall be made by ONEEIGHTY NETWORKS in its sole discretion; (iv) engage in conduct which violates the legal rights of others, including without limitation harassment, defamation, libel, obscenity, or threatening conduct, which determination you agree shall be made by ONEEIGHTY NETWORKS in its sole discretion;

(v) publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information; (vi) upload files that contain software or other material protected by intellectualproperty laws (or by rights of privacy of publicity) unless they own or control the rights thereto or have received all necessary consents; or (vii) upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer. The sending of any unsolicited commercial e-mail messages through the ONEEIGHTY NETWORKS Internet Services utilizes electronic mail servers located in the state of Washington and is strictly prohibited.

 
Internet Relay Chat
 
Users may not use any programs that may or will interfere with another party's use of the Services. Users may not run any Internet Relay Chat ("IRC") robot on any IRC server. When logged into any IRC server, users must comply with the rules and policies established by such IRC server's administrator.

 
Forgery or Identity
 
Users may not falsify address information or otherwise modify headers to conceal the sender's or recipient's identity, for the purpose of circumventing this Net Abuse Policy or for any other purpose. This provision is not intended to disallow the use of aliases or anonymous remailers for any legitimate purpose.

 
Cooperation with Other Providers
 
Users may not use the Services or any ONEEIGHTY NETWORKS facilities to engage in activities that violate any terms or conditions of service of any other network access provider or Internet service provider.

 
Modification
 
ONEEIGHTY NETWORKS reserves the right to change the terms, conditions, and notices under which the Services are offered, including but not limited to the charges associated with the use of the Services. Users must review these terms and conditions. ONEEIGHTY NETWORKS may at any time make improvements and/or changes in the policies affecting its Services.

 
Termination for Violation

 
ONEEIGHTY NETWORKS reserves the right, in its sole discretion, to terminate or temporarily suspend your access to the Services and any services or any portion thereof at any time, without notice, in the event you violate any terms or conditions contained herein. Any such violation may result in criminal and civil liability. In the event of any such termination, users will not receive any refund or credit for any amounts paid to ONEEIGHTY NETWORKS.
